Coalition of EU Creators and Rightsholders Raises Serious Concerns about the Third Draft of the General-Purpose AI Code of Practice under the EU AI Act: No Code is Better Than the Fundamentally Flawed Third Draft

~ The third draft of the GPAI Code of Practice undermines the objectives of the AI Act, contravenes EU law and ignores the intention of the EU legislator – we cannot support it. ~

A coalition of creators and rightsholders across the EU’s cultural and creative sectors has issued a joint statement highlighting major concerns about the Third Draft of the General-Purpose AI (GPAI) Code of Practice. The third draft fails to align with the objectives of the AI Act, misinterprets EU copyright law, and undercuts the obligations set out in the AI Act itself. Rather than providing a robust framework for compliance, it sets the bar so low as to provide no meaningful assistance for authors, performers, and other right holders to exercise or enforce their rights. Even more fundamentally, it would also not ensure that GPAI providers comply with either EU copyright law or the AI Act.

Despite having participated constructively in the drafting process and providing substantive comments on previous drafts to address critical issues, the coalition’s key concerns have been ignored. The coalition calls for substantial improvements to ensure that the Code upholds EU law and provides meaningful protections for authors, performers, and other rightsholders. Without these improvements, the Third Draft would not meet the adequacy requirement set out by the AI Act and therefore could not be approved.
